Welcome to Face Shape Detector (the "Service"), operated by Face Shape Detector ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the Service.

2. The Service

Face Shape Detector provides AI-powered face shape analysis and personalized style recommendations. You upload a photo, and our proprietary algorithms analyze your face shape and generate customized hairstyle and styling recommendations.

Free Preview: Includes basic face shape analysis and 1 hairstyle preview.
Premium: Includes complete analysis with 12 personalized hairstyles, golden ratio analysis, symmetry analysis, and styling guides. See current pricing on our website.

We may change, suspend, or discontinue parts of the Service at any time. We provide reasonable efforts to maintain availability but do not guarantee uninterrupted access.

3. Eligibility & Age Requirements

You must be at least 18 years old to use this Service.

Our Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If you are under 18, you may NOT use this Service.

Why 18+: Our Service processes facial images, which requires informed consent. We believe users should be adults to provide such consent independently.

We reserve the right to request age verification and terminate accounts of users under 18.

4. Account & Registration

You may use the Service as a guest (no account required) or create an account to save your results.

If you create an account: You agree to provide accurate information and keep your credentials confidential. You are responsible for all activities under your account. Notify us immediately of any unauthorized use.

5. Your Photos & Responsibilities

Ownership

You own all rights to the photos you upload and the analysis results we generate for you.

License to Us

By uploading a photo, you grant us a limited, non-exclusive, royalty-free license to process your photo solely to provide the Service to you. This license ends when you delete your photo or analysis.

No AI Training

We do NOT use your photos to train AI models. Your photos are used only to generate your personalized analysis.

Your Responsibilities (IMPORTANT)

You represent, warrant, and agree that:

  • ✓ The photo is of YOU, or you have explicit written consent from the person in the photo
  • ✓ You are at least 18 years old
  • ✓ You own the photo or have permission to upload it
  • ✓ The photo does not violate any third-party rights (copyright, privacy, publicity)
  • ✗ You will NOT upload photos of strangers, celebrities, or public figures without consent
  • ✗ You will NOT upload photos of minors (anyone under 18)
  • ✗ You will NOT upload photos obtained illegally or without permission
  • ✗ You will NOT upload illegal, harmful, hateful, or exploitative content

Prohibited Uses

You agree NOT to use this Service for:

  • Identity verification or authentication
  • Employment screening or hiring decisions
  • Insurance, credit, or financial decisions
  • Law enforcement or surveillance
  • Creating deepfakes, manipulated media, or misleading content
  • Harassment, stalking, or tracking individuals without their consent
  • Uploading photos of others without their explicit permission
  • Any discriminatory purpose
  • Any use that violates someone's privacy, dignity, or rights

Violation of these terms may result in immediate account termination and legal action.

6. Acceptable Use

You agree not to:

  • Use the Service in violation of any law or regulation
  • Attempt to probe, scan, or test security vulnerabilities
  • Bypass usage limits or abuse the Service
  • Use automated scraping or excessive programmatic calls
  • Upload malware or malicious content
  • Impersonate others or provide false information

We may suspend or terminate access for violations without notice.

Premium Analysis

One-time payment at the current price listed on our website. Includes:
• Complete face shape analysis
• 12 personalized hairstyle recommendations
• Golden ratio analysis
• Symmetry analysis
• Brow recommendations
• Stylist scripts for each hairstyle
• 90-day access to your results (we recommend saving by printing or screenshot for permanent offline storage)

Payment Processing

Payments are processed securely by our payment processor. We do not store your credit card information. You authorize us to charge your selected payment method for the amount shown at checkout.

No Refunds Policy

All sales are final. We do NOT offer cash refunds.

Why: Our Service delivers instant, personalized analysis the moment you complete payment. Once you view your premium results, the service has been fully provided. Unlike subscription services, there is no ongoing service to cancel.

Before you purchase: We provide a free preview so you can evaluate the quality of our analysis before paying. Please review your free preview carefully before upgrading.

Founder Support for Technical Issues

While we do not offer cash refunds, we are committed to your satisfaction. We take responsibility for technical issues, but not for subjective aesthetic preferences.

We ARE responsible for technical issues such as:

  • Analysis failed to generate after payment
  • Images failed to load or display
  • Results are clearly inaccurate due to a technical error (e.g., wrong face detected)
  • Payment was charged but premium features were not unlocked
  • System errors or bugs that prevent you from accessing your results

We are NOT responsible for:

  • Dissatisfaction with hairstyle recommendations or styling suggestions
  • Subjective disagreement with face shape analysis results
  • Personal preference differences (e.g., "I don't like these hairstyles")
  • Changes of mind after viewing results

How to get support: If you experience a genuine technical issue, contact our founder directly at support@faceshapedetector.net within 7 days of your purchase. We will investigate and work with you to resolve the issue.

Resolution options for verified technical issues:

  • Re-run your analysis with technical fixes applied
  • Provide a credit for one future analysis (no cash refunds)
  • Manual review and correction of technical errors

This keeps the value within our platform and ensures you get the quality analysis you paid for, while maintaining our no-cash-refund policy.

8. Data & Privacy

Your use of the Service is subject to our Privacy Policy. Key points:

  • Guest users: Your photos are NOT stored permanently. They are processed in real-time and discarded when you close your browser. In rare cases, due to technical processes, some data may remain temporarily in our systems for up to 24 hours before automatic deletion.
  • Logged-in users: Your photos and analysis are saved to your account for 90 days. After 90 days, reports may be automatically deleted. We recommend saving important results by printing or screenshot. You can delete them anytime from your account settings.
  • Communications: We send essential account-related emails (verification, password resets) and occasional product updates. You can opt out of promotional emails anytime.
  • No data selling: We never sell your data to third parties.

9. Sharing Feature

You may generate a share link to show your analysis results to others. When you share:

  • Anyone with the link can view your results (read-only)
  • The link remains active until you revoke it or delete your analysis
  • You can revoke sharing at any time from your account
  • If you delete your analysis, all share links become invalid immediately

Important: Only share your link with people you trust. We are not responsible for how others use your shared content.

10. Intellectual Property

Our IP

The Service, including our proprietary algorithms, software, UI, trademarks, and content we create, is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse-engineer the Service.

Your IP

Your photos and analysis results remain yours. We claim no ownership over your content.

Feedback

If you send us suggestions or feedback, you grant us a perpetual, worldwide, royalty-free right to use them without obligation to you.

11. Disclaimers & Limitations

Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Guarantees

We do NOT guarantee that:

  • Recommended styles will suit you or look good on you
  • AI analysis is 100% accurate
  • Stylists will interpret our recommendations correctly
  • You will be satisfied with the results
  • The Service will be uninterrupted, error-free, or secure

Not Professional Advice

Our Service provides entertainment and informational recommendations only. It is NOT a substitute for professional consultation with licensed cosmetologists, dermatologists, or beauty experts.

Use at your own risk. We are not responsible for any dissatisfaction with hairstyles, styling decisions, or beauty outcomes based on our recommendations.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACE SHAPE DETECTOR (AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS) SHALL NOT BE LIABLE FOR:

  • Any dissatisfaction with hairstyle or beauty results
  • Any harm from following our recommendations
  • Any errors or inaccuracies in AI analysis
  • Any loss of data or photos
  • Any indirect, incidental, special, consequential, or punitive damages

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months before the claim. For free users, our maximum liability is $0.

Some jurisdictions do not allow certain limitations, so the above may not fully apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

12. Your Legal Responsibilities

Protection Against Third-Party Claims: If someone sues us because of your actions, you agree to protect us and cover any costs.

Specifically, you agree to defend, indemnify, and hold Face Shape Detector (and our affiliates, officers, employees, agents, and licensors) harmless from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your photos: If you upload someone else's photo without permission and they sue us, you're responsible
  • Your violations: If you violate these Terms or any law while using our Service
  • Third-party rights: If you infringe someone's copyright, privacy, or publicity rights
  • Your use of the Service: Any harm or damage caused by how you use our Service

Example: If you upload a celebrity's photo without permission and they sue us for privacy violation, you agree to cover our legal costs and any damages.

Why this matters: This protects our business from being held responsible for your actions. We provide the technology; you're responsible for using it legally and ethically.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms.

You may stop using the Service and close your account at any time. You can delete all your data from your account settings.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including liability limitations, indemnification, and dispute resolution) will survive termination.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms here with a new "Last updated" date.

Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, stop using the Service.

15. Dispute Resolution

Informal Resolution

Before filing any claim, you agree to contact us at support@faceshapedetector.net to attempt to resolve the dispute informally within 30 days.

Binding Arbitration (US Users)

If you are a user in the United States: You and Face Shape Detector agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding arbitration, rather than in court, except as noted below.

Arbitration Rules: The arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) Consumer Arbitration Rules. The arbitrator's decision will be final and binding.

Location: Arbitration will take place in the State of Delaware or remotely via video conference at your option.

Exceptions: Either party may bring a claim in small claims court if it qualifies. Either party may also seek injunctive relief in court to protect intellectual property rights.

Class Action Waiver (US Users)

If you are a user in the United States: You and Face Shape Detector agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, or any other representative proceeding.

This means you cannot join your claim with other users' claims, and you cannot bring a claim on behalf of other users. Each party may only bring claims in their individual capacity.

Why: This allows us to resolve disputes efficiently and keep costs low, which helps us maintain affordable pricing for all users.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Consumer Rights (EEA/UK/Switzerland)

If you are a consumer residing in the European Economic Area, the United Kingdom, or Switzerland: The arbitration and class action waiver provisions above do NOT apply to you. Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection laws of your country of residence. You may bring claims in the courts of your country of habitual residence.

Jurisdiction (Non-US, Non-EEA Users)

For users outside the United States and EEA/UK/Switzerland, any disputes not covered by mandatory consumer protections shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, United States.

16. Miscellaneous

  • Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us.
  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • Assignment: You may not assign these Terms without our consent; we may assign to a successor or affiliate.
  • No Waiver: Our failure to enforce a provision is not a waiver.
  • Force Majeure: We are not liable for delays or failures due to causes beyond our reasonable control.
